Firearm Surrender Project Guidelines

      When a domestic abuse, child abuse or harassment injunction is filed, the Clerk will:

      • provide the petitioner with the following three forms and explain that these forms must be served on the respondent with the Petition for TRO and the TRO and Notice of Injunction Hearing: (a) Information for Respondents Regarding the Surrender and Return of Firearms (CV-804V); (b) Respondent’s Statement of Possession of Firearms (CV-800); Notice of Firearms Possession Penalties (CV-432);

      • provide the Petitioner with the Petitioner’s Statement of Inventory of Possession of Firearms (CV-801V) and explain that the Petitioner may fill the form out and bring it to the injunction hearing if the Petitioner wishes to provide it in court.

      Injunction hearing

      At the injunction hearing, the court will collect forms CV-800V (required) and CV-801V (voluntary) and make a determination if the respondent has applicable firearms or if this issue is in dispute:

      • in either of the above circumstances, the court will complete the Order for Respondent to Surrender Firearms (CV-803V) and schedule a Hearing for Failure to Surrender Firearms.

      • the order will require the Respondent to surrender all firearms to the Kenosha Sheriff’s Department within two business days of issuance.

      • the Hearing for Failure to Surrender Firearms shall be set within 14 days from the issuance of the injunction;

      • if the respondent is not present at the injunction hearing, and if the court makes a finding that Respondent does possess firearms or this issue remains in dispute, then a Notice of Hearing for Failure to Surrender Firearms will be served upon the Respondent;

      • the Kenosha Sheriff’s Department will provide appropriate contact information and procedures for the surrender of firearms by Respondents and provide receipts that can also be transmitted to the court;

      • the court clerk shall notify the Kenosha District Attorney’s office of all Failure to Surrender Firearms Hearings;

      • if a respondent resides out of county, and wishes to surrender his/her forearms in another jurisdiction, this will be permitted with prior agreement and coordination by the Kenosha Sheriff’s Department.
