Appeals court grants stay in Wheatland placement

A Wisconsin Appeals court has granted a stay in placement, pending appeal, of a violent sex offender into a Town of Wheatland residence, according to a Kenosha County Sheriff’s new release Friday.

The placement involves Michael McGee, convicted in 1987 of second-degree sexual assault and burglary in Racine, into a 32200 Geneva Road residence, next door to where a 1-year-old lives.

McGee, who is still at Sand Ridge Secure Treatment Facility in Mauston, had his parole revoked when he allegedly molested a 10-year-old nephew.

“The Wisconsin Court of Appeals, District II, has ordered that the circuit court’s May 24th, 2016, order is stayed, pending appeal, regarding the placement of sex offender Michael McGee,” the news release stated.

In a 4-page ruling, the appeals court noted the stay in placement is in the “interest of the public and the interest in maintaining the status quo lead this court to conclude that a stay is appropriate.”

“The public has a strong interest in making sure that McGee’s supervised release plan, including the identified placement, was arrived at in accordance with the law,” the ruling added.

The stay in placement comes following months of litigation, including two filings in Racine County Circuit Court, where Judge Allan Torhost upheld the placement despite motions from the Town of Wheatland and Kenosha County corporate counsel.

In June, the Town of Wheatland filed a similar motion with the Court of Appeals, but was denied.

However, the appeals court later accepted the same motion from Kenosha County corporate counsel on May 31.

On the same day, Town of Wheatland building inspector Tim Popanda red-tagged the property, citing lack of permits.

But, after the home received inspection, the tag was removed.
